All website graphics, text, tables, charts, images and combinations thereof, and all software (html, javascript, dhtml etc.) and all other material are the copyright of Verteci Medical (A Square Tomato Ltd owned and operated website) or their suppliers or service providers.

All titles, brand names and product names are trade name/marks of their respective holders and fully respected.

Terms & Conditions of Business

Prices

All prices are quoted in UK pounds (Sterling) and include vat where applicable. Delivery is also included to all primary UK mainland destinations.

Prices are correct at the time of order only and relate to website purchases only. All orders for products are subject to availability and we reserve the right to refuse to fulfil any order without explanation.

Payment

Payment must be made by cheque, by one of the approved credit/debit cards, bank transfer or in sterling cash (Note: cash payment is not accepted by post).

Additional taxes may believed on goods shipped to countries outside the European Union. These import taxes, where imposed, are entirely beyond the control of the operators of Verteci Medical. 

Deposits

Deposits, where paid, are non refundable under any circumstances.

Legal Title

The owner and operator of Verteci Medical will possess legal title of the products until full payment has been received by us from the purchaser.

Order And Order Acceptance

The submission of an order, either via our website or by telephone or in any other form  does not constitute acceptance of an order.

The receipt of an order via the Verteci Medical website or by telephone or in any other form does not constitute acceptance of an order. 

The taking of a payment or deposit via the Verteci Medical website or by telephone order or in any other form does not constitute acceptance of an order. 

Delivery

Any specified delivery date or period for delivery will be considered as purely indicative. The delivery periods stated are estimates only and are based upon actual working days. Verteci Medical cannot be held responsible for delivery delays by third parties.

Products will only be dispatched to to the postal address of the credit/debit card holder.

The purchaser bears all risk once the product(s) have been received and/or signed for.

Acceptance

Purchasers must inspect products promptly upon receipt and notify the operator of Verteci Medical should any issues arise. If this communication is not made the operator of Verteci Medical will consider the products as being of satisfactory quality and fit for their purpose, and may not accept any rejection or cancellation at a later date.

Right To Cancel

Where a deposit has been paid this will not be refunded under any cancellation circumstances.

Customers have the right to cancel their contract with us post ordering and before the expiry of 7 working days from the day after the date of purchase for products delivered boxed. Customers will receive a full (100%) refund of the purchase price less the restocking, packing, delivery, order and credit/debit card processing fees and collection charges where they apply.

For items delivered assembled and accompanied by an electric bicycle expert, we reserve the right not to accept returned items. Where a return is accepted you will receive a full (100%) refund of the purchase price less the restocking, packing, delivery, order and credit/debit card processing fees and any collection charges.

Where customer collection from our premises is agreed with us, customers must collect with seven days of ordering or a storage charge of £2.00 per square meter per day will be levied for floor space consumed and product insurance. Items not collected within 62 days of the date of order may be disposed of to recover floor space. Customers who, by prior agreement, choose to collect their order from us can cancel their order with 7 days of the date of purchase only if the product has not been collected.

If goods are to be returned, all must be in "as new" order upon their return and in the original packaging where appropriate.

*Warrantee

An item that arrives faulty or damaged may be returned to us for free repair, replacement or refund provided the original receipt or alternative proof of purchase is supplied and the faulty item is returned complete unused, with all components, documentation and packaging.

Items to be returned more than two weeks after delivery must in addition be accompanied by evidence of the existence of the fault or damage at the time of receipt.

The warrantee, against manufacturing and material defects is 12 months in duration and includes all major mechanicals including motor, gearbox, mechanical drive train, chassis, bearings, controller, seat support.   

All warrantee repairs are performed on a return to base basis. We will not arrange for goods to be returned however call us before shipping as we may be able to suggest a courier service.

No refund is available for fair wear and tear, damage or for products that due to the nature of their use can be readily damaged by being dropped, crashed, wetted, scraped, skidded etc. Such products include in no particular order junior electric scooters, electric quads/atvs and mountain bikes and all products when misused and/or mistreated and/or mis-maintained and/or abused.

The warrantee covers solely private use. 

The warrantee does not cover consumable components such as tyres, inner tubes, brake blocks/pads, brake cables, gear cables, bulbs, soft fittings, batteries, chains or belts and handgrips etc. Note: these and other components may be prone to rapid deterioration especially under some use and maintenance scenarios.

Due to storage constraints, products returned must be accompanied by valid claim within 62 days of the date of return or the items will either incur a storage fee or be disposed of without refund.

Please retain and return when requested all original packaging. All shipping costs post original delivery are the responsibility of the purchaser.

Commercial Use

All products are supplied and warranted for private use only. Where a purchase is being made for commercial use the private use warrantee is invalidated.

Replacement & Spare Components Parts

It is the responsibility of the purchaser and/or their agents to ensure that components purchased are entirely suitable to the application for which they are purchased. No component should be modified under any circumstances. All components supplied should be installed and tested by an appropriately qualified engineer or qualified mechanic.

General

Any and all age recommendations are for guidance purposes only and may not apply to your child due to size, stature, previous experience and medical conditions etc. The documentation accompanying all products should be read, thoroughly understood and implemented by a responsible adult.

Should any part or parts of these terms and conditions be deemed void, invalid or unenforceable the remaining part or parts will continue to be enforceable and effective.

We reserve the right to modify these terms and conditions.
